The Ternevskiy District Court of Kryvyi Rih has overturned a fine of 6,800 hryvnias imposed on a local resident for violating alcohol sales regulations. This information was reported by "Vidomo," referencing materials from the relevant case.
The incident took place in 2023 in Kryvyi Rih. During an internship at a café, the man sold a low-alcohol beverage "SHAKE" containing 7% alcohol to a minor. Before the sale, the seller verified the buyer's age using the "Diy" app, which indicated that the buyer was born in 2005, thus already of legal age, and only after that did he proceed with the sale of the alcoholic beverage.
The commission at the executive committee of the Ternevskiy District Council decided to impose a fine of 6,800 hryvnias on the violator, considering the administrative violation in his absence and without proper notification regarding the time and place of the hearing.
The Ternevskiy Court annulled the fine and ordered the executive committee of the Ternevskiy District Council to compensate the Kryvyi Rih resident 605.60 hryvnias for court fees.
As explained by the court, the basis for overturning the decision on administrative liability included several key points, notably the lack of proper notification about the hearing, which deprived the violator of his right to defense, as well as the absence of any wrongdoing on the part of the seller, since he checked the buyer's age through the "Diy" app. Furthermore, the legislation does not require sellers to verify the validity or authenticity of a passport or other documents confirming the buyer's age.
Thus, the seller acted within the framework of existing legislation by verifying the buyer's age as required by law.
