The date of an employee's hiring does not affect the ability to reserve them from mobilization. This was stated by the Ministry of Economy in response to a request from RBK-Ukraine.
Today, media reported that employees of critical enterprises who were hired after May 18, 2024, supposedly do not qualify for reservation. The ministry denies this.
The agency claims that for reservation, an individual must be registered for military service, timely update their registration details, not be wanted, work officially, and earn more than 20,000 hryvnias per month.
"There are no requirements regarding the date of employment in the new reservation criteria," the ministry explained.
It is noted that May 18, 2024, is the date on which the number of employees eligible for reservation is recorded. For example, if the enterprise has 100 military-registered employees as of this date, the right to reservation applies to 50 individuals – half of the total. Therefore, if 20 of the unreserved employees are later mobilized, the enterprise still retains the right to reserve for 50 workers, as the count is based on the 100 individuals as of May 18, not the 80 that remain de facto.
Mobilization and Reservation in Ukraine
As reported by UNIAN, earlier today, Member of Parliament Bohdan Kytsak, clarifying the new Cabinet resolution on reservations, stated on television that for reservation, an employee must have been employed at the enterprise before May 18, 2024. According to him, those who started working after this date will not have the right to deferment.
It should be added that earlier lawyer Marina Bekalo stated that timely updating of registration details is not mandatory to obtain a deferment from mobilization if one is eligible. According to her, the procedure for obtaining a deferment is clearly outlined in the government resolution, and it does not mention anything about untimely updates of registration details. However, this specifically pertains to deferment, not reservation.
